It is a felony to compel disclosure of a Social Security Account Number. Federal statute 42 U.S.C. § 408(a)(8) unequivocally deems any party that compels disclosure of a Social Security Account Number to be a felon. No ifs, ands or buts. ONLY A FEDERAL STATUTE can override this, and only by direct statutory enumeration directed at individuals, to make disclosure "mandatory". Organizations or agencies claiming that "disclosure is mandatory" had really better make good and sure that is true in federal law, or they are felons. It is exceedingly rare to find any federal statute addressing individuals and ordering to them that "disclosure is mandatory". And even then, several other particular specific conditions must be met for that mandate to be enforceable against any individual.
SO, before YOU must disclose a Social Security Account Number, the following conditions must be met: 1) the solicitation for a Social Security Account Number must be from a government agency; 2) a specific statute (of any jurisdiction) must address that government agency and enumerate a requirement upon that agency to solicit Social Security Account Numbers from individuals in your situation; 3) a specific federal statute enacted by Congress must address you in the specific situation that you are in; 4) that federal statute must instruct you that "disclosure is mandatory" in that situation; 5) a Privacy Act Notice must accompany the solicitation; 6) that Privacy Act Notice must do ALL of the following: a) state that solicitation is mandated pursuant to the specific statute of any jurisdiction, enumerating that statute; b) state that "Disclosure is Mandatory"; c) enumerate that disclosure is made mandatory by the specific federal statute, enumerating that federal statute.
IF ANY ONE of the above requirements is not met, disclosure may not legally be compelled, and any who attempt to do so are felons. So pay attention next time someone or something asks for your Social Security Number – see how many felons you start to notice. And make no mistake – when you notice the felons that you are encountering, that feel so entitled to abuse some position or authority over you, you are witnessing their psychological makeup, a makeup that they take with them throughout their world. These are the psychologies that take that same entitlement home, that beat their own wives and children, that rape – that certainly steal as they have just done from you, stealing your identity, being felons.
